CHILD SUPPORT GUIDELINES

Federal law requires each state to use a mathematical formula to determine that amount of child support to be paid.

There are two main types of guidelines used by states:

  1. Percentage guidelines which are based on net or gross percentage of non-custodial parent’s income. For example, if you have one child, 13% of net income is for child support payments.
  2. Income Shares or Combined Parental Income guidelines which are based on the income of both parents and cost of raising children.

Example of a  20% Due Percentage Guideline

Mom’s Income       Dad’s Income

$35,000                  $50,000

20% = $7,000       20% = $10,000

Example of  Combined Income Guideline

Mom’s Income       Dad’s Income

$35,000                  $50,000

Combined

$85,000

Guideline Chart Shows Cost of Raising Child for family with $85,000 is  $20,000

since 35,000 is  25% of $85,000 – Mom owes 41% of $20,000 = $8,400

since $50, 000 is 58% of $85,000 – Dad owes 58% of $20,000 =  $11, 600

Primary caretaker receives payment, there may also be an additional amount due for child care, medical support, number of children or if shared parenting a reduction due to time share.
