- The first step is to legally notify (“serve”) the other parent with the notice of court action. This called Legal Service of Process.
- This legal notice is often called a summons. It tells the person to appear at court on a certain day and time. A summons can be delivered in person (personal service) or by registered mail. For initial filings, the very first time you are going to court, it is usually best to use personal service so no questions arise about if the person was properly legally served.
- If the person cannot be served personally, be creative use Federal Express, give it to a Pizza Delivery person or friend (if allowed by your state law—check with your Clerk of Courts to find out the rules for legal service of process), or hire a private process server. Most Clerks of Courts Offices have a list of local process servers who will serve a summons for a small fee.
